Just in: Court Admits Judgment on Military Raid of Kanu’s Home as Evidence

The Federal High Court in Abuja has accepted three judgments as evidence, notably including the N1 billion in damages awarded by Justice Benson Anya of the Abia State High Court against the Nigerian government.

This award stems from the 2017 military invasion of the residence of Nnamdi Kanu, the leader of the proscribed Indigenous People of Biafra (IPOB).

Justice Anya’s judgment, delivered in a fundamental rights suit filed by Kanu, had previously declared the September 2017 military invasion of Kanu’s home to be illegal, unlawful, and unconstitutional.

The court ruled that this action violated Kanu’s fundamental rights to life, dignity of person, liberty, and fair hearing, as guaranteed by the 1999 Nigerian Constitution and the African Charter on Human and People’s Rights.

The court also admitted in evidence certified true copies of judgments in suits FHC/UM/CS/30/2022 (Nnamdi Kanu vs FRN) and E/20/2023 (Kanu vs FRN), delivered on October 26, 2022, and another unspecified date for the latter.

Justice James Omotosho admitted the three judgments, tendered through the Bar, and marked them as exhibits PWL, PWM, and PWN, respectively, on Wednesday.

The three judgments were tendered by the defendant team during the cross-examination of the prosecution witness, simply identified as Mr. BBB.

The cross-examination was conducted by Mr. Paul Erokoro (SAN).

Persecondnews recalls that Kanu has been in DSS detention in Abuja since he was rearrested in Kenya and subjected to extraordinary rendition back to Nigeria on June 27, 2021.

He was arrested by Kenyan security operatives in collaboration with Nigerian authorities.
