Supreme Court to decide Nnamdi Kanu’s fate December 15

The Supreme Court has fixed December 15 to decide the fate of the leader of the proscibed Indigenous People of Biafra (IPOB), Nnamdi Kanu.

A five-member panel of the Supreme Court, led by Justice Kudirat Kekere-Ekun, on Thursday, after adopting the final submissions of counsel to the federal government, Tijani Gazali (SAN), and counsel to Kanu, Mike Ozekhome (SAN), okayed the matter for judgment.

The federal government lawyer urged the apex court to set aside the judgment of the Court of Appeal which rescinded the treasonable felony charge against the IPOB leader and ordered his release.

However, in the submission of Ozekhome, he urged the Supreme Court to take a clue from Ojukwu Vs State, “to demonstrate that no man or government should be above the law.”

“We urge My Lords to uphold our Cross-Appeal in order to do substantial justice to this matter and to the Respondent who has been in detention since June 29, 2021, even after the lower court ordered his release and that he should never be prosecuted again on the same counts,” Ozekhome said.

Contrary to the judgment of the Appellate Court which quashed eight out of the 15-count charge against Kanu and also set him free, Ozekhome during his submission had said:“They are still holding him unconstitutionally.”
