The Supreme Court has thrown out a lawsuit seeking to oust President Bola Tinubu from office, labelling it “frivolous” and slapping a N5 million fine on the plaintiff, Ambrose Owuru.
This decision comes after Owuru, a 2019 presidential candidate, filed the lawsuit in an attempt to remove Tinubu from office.
The court’s ruling is a significant victory for the president, solidifying his position and dismissing Owuru’s claims as baseless.
The court, led by Justice Uwani Musa Abba-Aji, unanimously dismissed the suit.
It further warned the Registry of the Supreme Court not to accept any frivolous originating summons from the plaintiff again.
Owuru, a presidential candidate of the Hope Democratic Party (HDP) in the 2019 general election, sought Tinubu’s removal based on Central Intelligence Agency (CIA) and drug allegations.
In his lawsuit filed directly with the Supreme Court, Owuru made several claims, including that President Tinubu is an active CIA agent.
The plaintiff also urged the Supreme Court to disqualify Tinubu, citing his forfeiture of $460,000 to the US government in a drug-related case as grounds for disqualification.
Owuru petitioned the court to invoke Section 157 of the 1999 Constitution and remove Tinubu from office, citing allegations that he is under the control of foreign authorities.
The plaintiff, whose party was deregistered by the Independent National Electoral Commission (INEC), filed a suit, SC/CV/667/2023, naming ex-President Muhammadu Buhari as a defendant, alongside President Bola Tinubu, the Attorney General of the Federation, and INEC.
When the case was called up for hearing on Monday, Owuru, donning a lawyer’s wig and gown, chose to represent himself and argue his case personally.
Persecondnews recalls that the Abuja Division of the Court of Appeal imposed a N40 million fine on the plaintiff on May 25, 2023, for filing a “frivolous” suit aimed at stopping President Tinubu’s inauguration.
Also, Owuru previously attempted to block ex-President Muhammadu Buhari’s inauguration, alleging that the INEC helped Buhari manipulate the 2019 presidential election results.
He claimed that the 2019 presidential election was initially scheduled for February 16, 2019, but the INEC postponed it about five hours to the commencement of the poll, eventually holding the election on February 23, 2019.
Owuru also alleged that, prior to the postponement, he had won a referendum conducted and monitored by both foreign and local organizations.
He claimed he received over 50 million votes in a referendum, surpassing the votes of other presidential candidates, including Buhari.
The British-trained lawyer who was called to the Nigerian Bar in 1982 stated that Buhari’s tenure was illegal.
Owuru alleged that he was the rightful winner of the 2019 presidential election, but Buhari seized his mandate and led the country for eight years.
He argued that if President Tinubu is disqualified, the Supreme Court should declare him the rightful president and order his immediate inauguration, allowing him to reclaim the mandate he claims was stolen from him.
