The Supreme Court on Thursday affirmed the Governor-elect of Osun State, Sen. Ademola Adeleke, as the authentic candidate of the People’s Democratic Party (PDP) for the gubernatorial election conducted in the state on July 16, 2022.
The apex court, in a unanimous judgment by a five-man panel of justices led by Justice Amina Augie, dismissed an appeal lodged against Adeleke by Prince Dotun Babayemi.
The justices maintained that the appeal was incompetent, stressing that it was filed outside the 14 days provided by law.
Persecondnews reports that Babayemi, a governorship aspirant on the platform of the PDP, had filed a suit against Adeleke, asking the court to invalidate the primaries that produced the Osun governor-elect, citing non-compliance with court order.
He also laid claim to the PDP governorship ticket of Adeleke after he emerged from a parallel primary election held by a faction of the party in the state.
Counsel to the Appellant, Mr Adebayo Adelodun (SAN), withdrew the appeal after the justices drew his attention to the fact that the case was “statute barred.”
