Unlawful detention : 6-month-old baby, family members slam N500m suit against DSS, Kebbi Govt

For alleged unlawful arrest and detention, a family of three including a six months old baby have instituted a legal action against the Kebbi State Government and the Department of State Service (DSS).
They were in custody of DSS for about 13 days without trial and are demanding N500 million as damages.
The complainants — Abdulrahman Jatau Nasiru Jatau, Hadiza Nasiru Jatau, Aisha Zakari — are residents of Yauri town.

 

They were arrested in their house by the DSS for allegedly seeking payment of their father’s gratuity.

 

The respondents in the case are SSS Kebbi state command, State Director of SSS, Kebbi State Government and Attorney General, Kebbi State.

 

In a suit filed at the Federal High Court, Birnin-Kebbi, before Justice Bassey Onu Sunday, the applicants were seeking for the Court relief to pronounce their detention and arrest illegal, which violated section 35(5) and 46(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended).

 

They are also seeking an order of the court directing the respondents to tender a public apology to the applicants.

 

The applicants want a declaration that their arrests and detention by the 1st and 2nd respondents based on the complaints by the 3rd respondent against the 3rd applicant as “illegal, unconstitutional and great violations” of the Constitution of the Federal Republic of Nigeria 1999 as amended.
