A Federal High Court sitting in Abuja has awarded N5 million as damages against the National Youth Service Corps (NYSC) for rejecting the discharge certificate of Governor of Enugu State, Peter Mbah, as forged.
Justice Inyang Ekwo, while delivering judgment on Monday, said the certificate presented to the Independent National Electoral Commission (INEC), by Mbah, was authentic and validly issued by NYSC.
He also held that Director-General of the NYSC and the corps, who were defendants in the suit, were guilty of misrepresentation of material facts.
He ruled that the NYSC was mischievous and acted in bad faith by denying Mbah’s NYSC certificate.
Mbah, had earlier in May 2023, sued the NYSC demanding N20 billion as compensation for what he described as conspiracy, deceit, and misrepresentation of facts after the NYSC issued a letter saying the certificate belonging to Mbah was not issued by the corps.
He approached the federal high court with an ex parte application after which the NYSC was restrained from further issuing a disclaimer on the certificate.
Apart from N20 billion damages, Mbah is seeking a declaration that he participated in the NYSC scheme for one calendar year via a call-up letter reference no. FRN/2001/800351 with the Lagos code LA/01/1532.
He wanted a declaration of the court that he was lawfully and legally issued a certificate of national service no. A808297 on completion of his service year in 2003.
