A Federal High Court in Abuja has issued an order restraining Prof. Pat Utomi and his associates from proceeding with their plan to establish a shadow government/cabinet in the country.
Justice James Omotosho issued the order on Monday, September 29, in a judgment on a suit by the Department of State Services (DSS).
Justice Omotosho declared the concept of shadow government/cabinet as unconstitutional and an alien concept to the nation’s presidential system of government.
The court rejected the defense’s claim, holding that Utomi and his associates’ right to association and criticism does not excuse unlawful activities.
The judge commended the plaintiff’s suit and affirmed the DSS’s right to take preventive steps against acts deemed capable of threatening the nation’s internal security.
