Sowore: Justice Minister says can’t order his release from DSS custody

Without foreclosing Omoyele Sowore’s release from the custody of the Department of State Service  (DSS), the

Attorney-General and Minister of Justice, Mr Abubakar Malami says his office cannot take the decision alone.
He was reacting to human rights lawyer, Femi Falana’s request to release the Convener of the #RevolutionNow protests, Sowore.
Falana had written to the AGF asking for the release of Sowore following a decision by Malami to withdraw Sowore’s case from the DSS.
Falana who is the lead defence counsel to Sowore, currently being detained by the DSS.
But Malami said: “The Federal Government is guided by extant laws and tradition of the law in handling legal matters and related ligitations.”

“When parties submit their issues for determination to a court of law, they lack exclusivity of decision over such issues without recourse to the court.

“We remain guided by the established tradition and will not take a unilateral decision without recourse to the rule of law.”
