Shaibu’s reinstatement: Edo Assembly appeals court’s decision, requests stay of execution

584

The Edo State House of Assembly has filed an appeal challenging the Federal High Court’s ruling that overturned Mr. Philip Shaibu’s impeachment and restored him as Deputy Governor.

Additionally, the assembly asked for a stay of execution while the appeal process was ongoing.

Persecondnews recalls that on April 8, 2024, the Assembly voted to remove Shaibu from office after retired Justice S.A. Omonua’s seven-member investigative committee presented its report.

The panel was set up by the state Chief Judge, Justice Daniel Okungbowa.

The panel investigated Shaibu, a former House of Representatives member, on allegations of gross misconduct, perjury, and disclosing confidential government information.

18 of the 19 lawmakers present at the plenary, with one abstaining, impeached Shaibu despite his refusal to appear before the panel.

Following Shaibu’s removal from office, Gov. Godwin Obaseki appointed Mr. Godwins Omobayo as the new Deputy Governor.

Omobayo took the oath of office on the same day to serve as deputy governor for the remainder of Obaseki’s second term, which ends on November 12, 2024.

In his ruling today, Justice James Omotosho declared the impeachment of Shaibu null and void, ordering his reinstatement as deputy governor.

The court cited the Edo Assembly’s failure to follow proper procedures and protocols in their attempt to remove him from office.

The presiding judge ordered the Inspector-General of Police, Dr. Kayode Egbetokun, to provide Shaibu with the necessary security personnel to facilitate his return to office and perform his duties until the end of his tenure.

Additionally, the judge nullified the appointment of Omobayo as Shaibu’s replacement.
