The 2021 Executive Order 10 on the funding and autonomy of state judiciary and legislature issued by President Muhammadu Buhari has been declared unlawful and unconstitutional.
The Supreme Court judgment on Friday said Buhari exceeded his constitutional powers in issuing the executive order.
Six of the seven-member panel of the court gave the judgment, Persecondnews reports.
The apex court also dismissed the N66 billion suit filed by the 36 state governors against the Federal Government.
They held that it was not the responsibility of the Federal Government to fund the capital and recurrent expenditures of the superior courts created for states under Section 6 of the Constitution.
The justices said the states were not entitled to be refunded all they had spent before now to maintain those courts.
Persecondnews recalls that the 36 states had sued the Federal Government on the funding of the judiciary and the constitutionality of the EO10.
