Ihedioha loses as Supreme Court upholds its Imo judgment

…judgment that declared Uzodinma winner was entered in error, says minority verdict
Expectedly, the Supreme Court has thrown out the appeal of ex-Gov. Emeka Ihedioha of the Peoples Democratic Party (PDP) for a review of its judgment on the governorship of Imo State.

In a decision by a seven-man panel of Justices led by the Chief Justice of Nigeria, Justice Tanko Muhammad, the court reinstated the judgment it gave on January 14 which declared Hope Uzodinma of the All Progressives Congress (APC) as the validly elected governor of Imo.

PerSecondnews reports that a member of the panel, Justice Centus Nweze, however, disagreed with the lead judgment and gave a dissenting opinion that allowed Ihedioha’s application.

Nweze said he was satisfied that the judgment that declared Uzodinma winner was “entered in error”.

He held that the apex court has a duty to in the interest of justice, set aside its decision that was given in error.

But in the lead verdict delivered by Justice Olukayode Ariwoola, it held that Ihedioha’s application to set aside the judgment that removed him from office lacked merit.

The application is an invitation for the Supreme Court to sit on appeal over its own final judgement, the apex court ruled.

While dismissing the application, the  court, however, refused to award cost against the applicants.
