Breaking: Again FG floors ASUU as Appeal Court orders striking lecturers to resume work immediately

A marching order has been given by the Court of Appeal in Abuja to the striking Academic Staff Union of Universities (ASUU) to resume work with immediate effect.

In a ruling, the appellate court gave the order following an application filed by ASUU seeking the leave of court to appeal against the order of the National Industrial Court which had earlier ordered the striking lecturers to go back to the classrooms pending the hearing of the substantive matter.

Persecondnews recalls that on September 22, 2022, the industrial court had given an interlocutory order following an application brought by the Federal Government.

ASUU had appealed the ruling through its counsel, Mr Femi Falana (SAN) in an application dated September 28, seeking the leave of court to file an appeal against the industrial court order.

But on Friday, the Court of Appeal which had earlier granted ASUU “conditional leave to appeal the order of the Industrial Court”, insisted that ASUU must obey the order of the lower court with effect from today (October 7).

The three-man panel led by Justice Hamman Barka, in a unanimous decision, insisted that for ASUU to file a notice of appeal within seven days, it must show evidence that its members have already resumed work as at October 7.

“Failure to adhere to the order will make the appeal incompetent before Court of Appeal,” the judges said.
