Produce Igboho’s detained 12 aides in court on July 29, Court orders DSS

Twenty-three days after they were arrested and detained, the 12 aides of Sunday Adeyemo, a.k.a Sunday Igboho have got judicial reprieve as a Federal High Court in Abuja on Friday ordered the Department of State Service (DSS) to produce them.

The court granted the ex parte applications of the detained 12 including a woman.

Persecondnews recalls that the detained associates of Yoruba Nation activist, Sunday Adeyemo had instituted a suit against the DSS and its Director-General, Yusuf Bichi.

In his ruling, Justice Obiora Egwuatu ordered the secret police to produce them in court on July 29.

Egwuatu said the DSS should show cause why the applicants should not be admitted to bail having been kept incommunicado without trial since July 1 when they were whisked away from Igboho’s house in Ibadan after a bloody raid that claimed two lives.

The applicants’ counsel, Mr Pelumi Olajengbesi, in his ex parte motion urged the court to grant an order “mandating and compelling the respondents to produce the applicants” to enable the court “inquire into the circumstances constituting grounds of their arrest and detention” since July 1, 2021 and where it seems fit, grant applicants bail.”

They also want an order of the court mandating and compelling the respondents to produce the applicants before the court and show cause as to why the applicants should not be granted bail in accordance with the provision of Section 32 of Administration of Criminal Justice Act 2015 and other extant laws in Nigeria.

Olajengbesi who argued that the applicants are citizens of Nigeria with inherent fundamental rights, had
supported the ex-parte motion by an eight-paragraph affidavit, exhibit, 11-paragraph affidavit of extreme urgency, affidavit of non-complicity of action, and a written address.

The case has been adjourned to July 29.
